Terms and conditions

These terms govern the use of McCopado (mccopado.com) and its associated services. By creating an account, buying or selling on the platform you accept these terms. If you do not agree, you may not use the platform.

1. Who we are

McCopado is a marketplace for Latin America operated from the Republic of Ecuador. It brings together physical products, digital goods, services and community memberships offered by independent sellers, with local-currency payments and a built-in affiliate program.

2. Intermediary role

McCopado acts exclusively as an intermediary platform (broker) between buyers and sellers. Sellers are independent third parties: they are not employees, agents or partners of McCopado, and they are solely responsible for their products and services — their quality, legality, description, warranties, delivery and regulatory compliance.

The sale contract is entered into directly between the buyer and the seller. McCopado does not manufacture, store, inspect or own the listed products. For its technology and payment intermediation service, McCopado earns a commission and invoices only that commission.

3. Accounts

You must be 18 or older to use McCopado. You are responsible for keeping your credentials secure. One account per person; do not share passwords. We may suspend accounts showing suspicious or fraudulent activity, or activity that breaches these terms.

4. Purchases and product types

  • Physical products: shipping times and costs are visible before payment. Dispatch and delivery are the seller's responsibility.
  • Digital products: immediate access once payment is confirmed.
  • Services: delivery is coordinated with the seller; specific cancellation conditions on the service page.
  • Memberships: access to the McCopado Teams space according to the purchased membership tier.

5. Prices, currencies and payments

Prices are displayed in the local currency of the selected country. Payments are processed through external gateways enabled per country — PayPhone in Ecuador and Mercado Pago in Argentina, among others we may add — or with your McCopado wallet balance. We do not store card numbers: tokenization and custody of payment data are handled by the payment provider.

6. Sellers

Sellers are responsible for the quality, accurate description, lawfulness and legal compliance of their products and services, including handling warranties and claims. McCopado retains a service commission on each net sale for the intermediation; the current percentage is shown in the seller panel and may vary by country, category, account configuration and payment-provider policies. Seller earnings are credited to their wallet and withdrawn according to the cycle configured in the panel.

7. Taxes

Each seller is solely responsible for their tax obligations arising from sales made through the platform: registration, filing, invoicing and payment of the taxes applicable in their jurisdiction. For example: in Argentina, the monotributo or responsable inscripto regime depending on their situation; in Ecuador, obtaining a RUC and the general or RIMPE regime as applicable.

McCopado does not withhold or file taxes on behalf of sellers and issues receipts only for its intermediation service commission. Buyers are responsible for any import taxes, duties or fees that apply to cross-border purchases.

8. Affiliates and referrals

Any user can generate affiliate links for eligible products. The commission accrues on the purchase actually completed in the session started from the affiliate link and is credited to the affiliate's wallet in the same currency the buyer paid, with no currency conversion of any kind.

Country rule. The commission for a local product (a physical product, service or infoproduct sold in a country's currency) is credited only if the affiliate's account belongs to the same country as that sale; it is credited in that country's currency. If the affiliate's account is from another country, no commission is credited for that purchase, even when the affiliate link originated the sale. To earn commissions on sales in another country, the affiliate must operate an account from that country. Global products are always sold in US dollars (USD) and their commission is credited in USD to the affiliate's USD wallet, regardless of their country. Each wallet is independent per currency: balances are never converted between one another and are withdrawn in their own currency.

Attribution ends with that purchase: no standing attribution survives over the same buyer's later purchases, and each buyer generates a commission for the same affiliate only once. The referral program grants bonuses for inviting new users under the conditions published on the referrals page. Self-clicking, attribution manipulation and spam void the commissions generated.

9. Returns, cancellations and refunds

  • Defective physical products: 7 days to report; refund or replacement.
  • Digital products: you may request a refund within 7 days if the content does not match what was published or does not deliver what was offered. Each request is reviewed case by case, and the outcome may be a refund, wallet balance or access to different content.
  • Services: see the seller's specific policy.
  • Orders pending payment confirmation (for example, phone payment) are automatically cancelled after 24 hours if payment is not confirmed; no charge is made.

10. User content and intellectual property

By uploading images, videos, audio, text or other content to the platform you declare that you hold the necessary rights over that material. You grant us a limited, non-exclusive, worldwide, royalty-free license to host, reproduce and display it for the sole purpose of operating and promoting the platform. The license ends when you delete the content, except for transient technical copies.

Uploading content that infringes copyright, trademarks, image rights or other third-party rights is prohibited. We may remove infringing content without prior notice.

11. Content takedown policy (notice & takedown)

If you are a rights holder (or their representative) and believe that content published on McCopado infringes your rights, write to info@mccopado.com including:

  • Identification of the protected work or subject matter.
  • The exact URL of the allegedly infringing content within the platform.
  • Your contact details (name, email).
  • A good-faith statement that the reported use is not authorized by the rights holder, their agent or the law, and that the information provided is accurate and you are entitled to act.

We expeditiously remove verified infringing content and notify the user who published it, who may file a counter-notification to the same email if they believe the removal was mistaken. Accounts with repeated infringements are terminated.

12. Use of artificial intelligence

The platform currently does not use artificial intelligence in its features. We may adopt AI tools for specific improvements — for example product recommendations, support assistance or content moderation — and, when that happens, we will update this section stating their scope. No AI-generated content is presented as human-made.

13. Prohibited conduct

  • Illegal or counterfeit products, or products infringing third-party rights.
  • Review manipulation, affiliate self-clicking, payment fraud.
  • Harassment, discrimination, or offensive content on McCopado Teams.
  • Circumventing the platform to avoid commissions on transactions originated in it.

14. Limitation of liability

The platform is provided "as is". To the maximum extent permitted by law, McCopado is not liable for indirect damages, loss of profits or loss of data arising from the use of the platform, nor for the acts or omissions of sellers, whose responsibility is their own under section 2. McCopado's total maximum liability is limited to the amount paid for the transaction giving rise to the claim. Nothing above limits non-waivable consumer rights under applicable public-order rules.

15. Dispute resolution and arbitration

Before starting any formal claim, contact us: most issues are resolved through support. If we cannot reach an agreement, the parties first submit to mediation and, if the dispute persists, to binding individual arbitration under the Arbitration and Mediation Law of the Republic of Ecuador, before an arbitration center legally established in Ecuador, in Spanish and under Ecuadorian law.

You agree to resolve disputes on an individual basis: you waive participation in class or collective actions against McCopado and, in jurisdictions where applicable, jury trials. Excluded from this clause are: (a) small claims that may be brought before the competent courts of your domicile, and (b) injunctive or urgent relief for intellectual property infringement.

16. Changes to these terms

We may update these terms. If the change is material we will notify you by email or through a notice on the platform with reasonable advance notice; the "last updated" date at the top always reflects the current version. Continuing to use the platform after the effective date constitutes acceptance of the new terms.

18. Raffles and ticket campaigns

18.1 Nature of the campaign. Every raffle campaign is published with a fundraising goal and a prize table tied to percentage milestones of that goal. Purchasing tickets grants participation solely in the draw for the prizes actually unlocked under clause 18.2, and confers no right over announced prizes whose milestone is not reached. Participation is restricted to persons aged 18 or over.

18.2 Prizes subject to funds raised. Prizes are funded out of the amount actually raised by the campaign. At close, only the prizes whose milestones have been unlocked as of that date are awarded; prizes tied to milestones not reached lapse automatically, giving rise to no indemnity, compensation, refund or claim of any kind. By way of illustration: where twenty-five per cent (25%) of the goal is reached, the prizes up to that milestone are drawn and delivered, and none of the higher ones. Campaign progress is displayed publicly and at all times on the raffle page.

18.3 Delivery and winners in another jurisdiction. The prize is delivered solely to the holder of the winning ticket, upon verification of identity with a valid document. Where the winner resides in a country other than that of the campaign, McCopado shall purchase the equivalent prize in the winner's country of residence or, at the winner's election, pay the cash value of the prize based on the published reference price, McCopado being thereby released from any further obligation regarding shipping, importation, customs duties or comparable costs.

18.4 Finality and validity. Ticket purchases are non-refundable once payment is confirmed. The draw is conducted by verifiable random selection, broadcast live and with the oversight announced for the campaign; any decision as to its validity is final. The winner accepts that their name may be announced during the broadcast and that delivery of the prize may be recorded as evidence of performance.

18.5 Tickets and prior acceptance. By purchasing tickets the participant enters the draw for real prizes and accepts these rules, whose reading and acceptance are requested once and recorded in their account for subsequent purchases. Each purchase issues tickets with an identifiable code and, where the campaign offers packages or bonuses, the resulting quantity is shown in the summary before payment. Applicable taxes and the service surcharge in force are added to the chosen amount and itemised in that same summary: the total displayed before confirming is the only amount charged.

18.6 Accepted payment methods. Tickets may be paid by credit or debit card issued in any country, processed by the enabled gateway; by request sent to the gateway application linked to the buyer's phone number; by bank transfer within the Republic of Ecuador in United States dollars; or with USDT on the networks expressly accepted by McCopado. Transfer and USDT purchases are subject to manual verification of the receipt: tickets are issued once the payment is confirmed, and a transfer sent over a network other than those accepted may result in the irrecoverable loss of the funds, with no liability for McCopado.

18.7 Transparency and verifiability. Every campaign publishes its goal, its progress and the prize table with its milestones on a permanent basis. The draw is broadcast live and its outcome can be audited by any interested party through the ticket list and the recording of the broadcast, retained and published as announced for the campaign.

18.8 Framework. McCopado runs campaigns together with the person or brand promoting them, acting as the technology and payment platform under clause 2, and is answerable for the correct issuance of tickets, the conduct of the draw and the delivery of the unlocked prizes on the terms of this section. Campaigns are run subject to the law applicable in the jurisdiction from which McCopado operates; where that law requires authorisation, registration or the involvement of a third party, the campaign is published only once that requirement is met. McCopado staff and persons connected with the organisation of the campaign may not take part.

18.9 Adjustment of the prize table and of the number of winners. Where, at the close of the campaign, the amount raised does not reach all of the announced milestones, McCopado may adjust the number of winners to the number of prizes actually unlocked. By way of illustration: where three prizes were announced and only one is unlocked, the draw is held for that single winner. Any such adjustment is published on the campaign page before the draw takes place and gives rise to no claim, indemnity or refund.

18.10 Announcement of results. Every announcement of results — broadcast, email, in-platform notifications or publication — refers solely to the prizes actually unlocked and to whoever wins them. No person is ever announced as the winner of a prize whose milestone has not been reached. If no milestone has been unlocked at the close of the campaign, no draw is held and there are no winners, and McCopado will inform participants of the resolution adopted — extension of the term or closure of the campaign — under clause 18.2.
